REVISED: 4.9.09 FRESH SHIRT AND TIE CLUB TERMS AND CONDITIONS

Each month, for six months, participants in the Fresh Shirt and Tie Club (the "Program") automatically will receive either (i) a single non-iron dress shirt; or (ii) a single non-iron dress shirt and 100% silk tie, depending on the level of participation selected. Shipping is free.

All participants will receive the same style and color of shirt and, if applicable, tie, as selected by The Men's Wearhouse in its sole discretion. Participants are responsible for providing The Men's Wearhouse with accurate size information.

All participants must be at least 18 years of age and must make their purchases using a Perfect FitĀ®, VISA, Discover, MasterCard or American Express credit card. The monthly fee, plus any taxes, will be charged against a participant's credit card at the time of shipping. By enrolling in the Program, each participant consents to such charges by The Men's Wearhouse. No items will be shipped if a credit card has expired or the purchase is not approved. See our security policy for additional information regarding online purchases. Months during which a participant's card is expired or not approved will be counted toward such participant's membership commitment.

No coupons or discounts apply to the monthly fee charged to participants. Participants who are members of the Perfect Fit Rewards Program will earn rewards points on items purchased under the Program, in accordance with the terms of the Perfect Fit Rewards Program.

At the participant's election and cost, product will be shipped to an address designated by the participant. The Men's Wearhouse is not responsible for incorrect address information provided by a participant, or for packages left at an address.

Items generally will be shipped by the 10th day of each month. Delivery normally takes 5-7 business days. Participants will be provided with an email notification when items are shipped. Thereafter, items may be tracked online at http://ups.com by the tracking number provided in the shipping confirmation email. Additionally, participants may also check the status of an order by calling Men's Wearhouse toll-free at 1-877-986-9669 for assistance, and providing the order confirmation number contained in the email notification.

Participants not completely satisfied with their shirt or tie may return the items, unworn, to any Men's Wearhouse store within 90 days of the shipping date. The packing slip included in each shipment must accompany each return/refund. No on-line exchanges or returns are permitted.

Items may either (i) be exchanged for like items (i.e. another shirt or, if applicable, tie) of equal value ($59.99 for standard size shirts; $64.99 for big and tall size shirts; $39.99 for standard size ties; $42.99 for big and tall size ties); or (ii) be returned for a full refund to the original credit card only. No cash refunds or store credits will be issued.

The Men's Wearhouse reserves the right to discontinue, amend, or modify the Program at any time, without notice. The Men's Wearhouse also reserves the right to accept or reject enrollments in the Program in its discretion, and to terminate any individual's participation in the Program at any time. Employees and family members of employees of The Men's Wearhouse, Inc. and its affiliates are not eligible for participation in the Program.

By enrolling in the Program, participants consent to the business use of their personal information (other than credit card information) by The Men's Wearhouse and its affiliates, and in limited circumstances, by third parties. Participants in the Program may at any time exclude themselves from calls, emails or mailings from The Men's Wearhouse.

A participant profile will be created by each participant at the time of enrollment in the Program. Participants may modify this profile at any time online, by email, by phone, or in writing at The Men's Wearhouse, Inc., Customer Relations, 6380 Rogerdale Road, Houston, TX 77072; 1-877-986-9669. Size, credit card, and shipment changes must be received no later than of the last business day of a month to effect shipments for the following month. Participants also may contact the Men's Wearhouse in any of these manners, at any time, to opt out of the Program, or to exclude themselves from calls, emails or mailings.
